Terms of Service

1. Acceptance of Terms

Welcome to YOURHOUND Pet Services, trading under Victaurus Pty Ltd (“Company”, “we”, “our”, or “us”). By accessing or using our online Pet Service marketplace (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

YOURHOUND Pet Services provides an online web based platform that connects pet owners (“Users”) with pet service providers (“Petpro’s”) for various pet-related services. Users can browse, book, and pay for services offered by Petpro’s through our website.

3. User Responsibilities

a. Users must provide accurate and up-to-date information when creating an account and booking services.
b. Users are responsible for reviewing and adhering to the terms set by Petpro’s for each service.

c. Users are responsible for the well-being and behavior of their pets during services booked through our platform.

4. Petpro Responsibilities

a. Petpro’s must accurately represent their services and provide clear and truthful descriptions.
b. Petpro’s are responsible for the quality and safety of the services they offer.

c. Petpro’s must maintain proper licenses, insurance, and certifications as required by local regulations.
d. Petpro’s must honor their commitments and deliver services as agreed upon with Users.

5. Prohibited Activities

Users and Petpro’s are prohibited from engaging in any activities that:

a. Violate any laws, regulations, or these Terms.

b. Infringe upon intellectual property rights.

c. Involve harassment, discrimination, or harmful behavior.

d. Attempt to manipulate reviews or engage in fraudulent activities.

6. Booking and Payment

a. Users can browse available services, view Petpro profiles, and book services based on availability.
b. Users agree to pay the specified service fees, including any additional charges as outlined by the Petpro.

c. Payments are processed securely through our platform. Refunds and cancellations are subject to the cancellation policy specified by the Petpro.

7. Additional Fees and Deductions

a. The Company reserves the right to add a percentage and/or admin fee to the total amount paid by Users for the Pet Services booked through the YOURHOUND Pet Services platform. This fee may be clearly indicated at the time of booking and will be included in the Users’ total payment.
b. The Company deducts a percentage and/or admin fee from the payment remitted to Petpro’s for the Pet Services provided through the platform.

8. Cancellation and Refund Policy

a. Bookings that are cancelled by Users are non-refundable. Users are encouraged to review and understand the cancellation policy specified by the Petpro before booking services.
b. If a booking is not completed by the Petpro due to reasons such as non-performance or failure to provide the agreed-upon services, Users have the right to request a refund.

9. Deduction of Refunds from Petpro Account Balance

a. In cases where Users are eligible for refunds as outlined in Clause 8, the Company reserves the right to deduct the refund amount from the Petpro’s account balance on the YOURHOUND Pet Services platform.

10. Liability, Injury, Loss of Pets, and Accidental Damage

a. Users, Petpro’s, and the Company acknowledge that the provision of pet-related services involves inherent risks and unpredictability.
b. Users and Petpro’s understand and agree that:

  • Petpro’s are independent contractors responsible for delivering services.
  • While the Company strives to connect Users with reputable Petpro’s, it cannot guarantee the safety or well-being of pets during service provision.
  • Petpro’s are responsible for the safety of their own property and belongings during service provision.
    c. Petpro’s further acknowledge their responsibility for the safety and care of Users’ property during service provision. d. The Company, its affiliates, and stakeholders shall not be liable for any injuries, loss of pets, accidental damage, or death that may occur during the provision of pet-related services.

11. Tax and UIF Responsibility

a. Petpro’s using the YOURHOUND Pet Services platform acknowledge that they are independent contractors and not employees of the Company.
b. The Company does not deduct tax and UIF (Unemployment Insurance Fund) from the payments to Petpro’s. Petpro’s are responsible for their own tax and UIF obligations. The Company will assist the South African Revenue Service (SARS) with any necessary information if requested.

12. WhatsApp Group Communication and Logging

a. As part of enhancing communication and transparency, Petpro’s on the YOURHOUND Pet Services platform have the option to create WhatsApp groups for services booked through the platform. Add Us to your WhatsApp group to backup your communication which could assist with disputes. Click WhatsApp to add our number.

13. Reviews and Ratings

a. Users can provide reviews and ratings for Petpro’s based on their experiences.

14. Privacy

a. We collect and use personal information in accordance with our Privacy Policy.

15. Termination

a. We reserve the right to terminate or suspend accounts for violation of these Terms or for any reason at our discretion. Users and Petpro’s can terminate their accounts at any time.

16. Changes to Terms

a. We reserve the right to modify or update these Terms at any time. Users will be notified of changes, and continued use of the Service constitutes acceptance of the updated Terms.

17. Disclaimers

a. We do not endorse or guarantee the accuracy, quality, or reliability of Petpro’s or their services.

18. Limitation of Liability

a. To the extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our Service.

19. Force Majeure

a. The Company shall not be liable for any delay, failure, or interruption of service resulting from circumstances beyond its reasonable control, including but not limited to acts of nature, government actions, or unforeseen technical issues.

20. Intellectual Property

a. Users and Petpro’s acknowledge that all content and materials available on the YOURHOUND Pet Services platform, including but not limited to logos, text, graphics, images, and software, are protected by intellectual property rights.

21. Third-Party Links

a. The platform may contain links to third-party websites or services. Users and Petpro’s acknowledge and agree that the Company is not responsible for the availability, content, or practices of such third-party sites.

22. Indemnification

a. Users and Petpro’s agree to indemnify and hold the Company, its officers, directors, employees, and affiliates harmless from any claims, damages, liabilities, and expenses arising from their use of the platform or their breach of these Terms.

23. Entire Agreement

a. These Terms constitute the entire agreement between Users, Petpro’s, and the Company and supersede any prior agreements or understandings, written or oral.

24. Governing Law

a. These Terms are governed by and construed in accordance with the laws of Republic of South Africa, without regard to its conflict of law principles.

26. Prohibition of Direct User Contact

a. Petpro’s using the YOURHOUND Pet Services platform agree to conduct all communication and transactional activities exclusively through the platform’s provided channels.

27. Non-Disparagement Clause

a. Users and Petpro’s agree not to engage in any activity that may disparage, defame, or harm the reputation of the YOURHOUND Pet Services platform, the Company, its affiliates, or any of its employees, officers, directors, or agents.
b. Users and Petpro’s further agree not to post, share, or publish any content that could be interpreted as negative, harmful, or misleading about the platform, its services, or its stakeholders.

c. This clause applies to all forms of communication, including but not limited to reviews, comments, social media posts, and public discussions.

d. The Company reserves the right to take appropriate legal action in the event of any breach of this non-disparagement clause.

28. Mutual Non-Disparagement Clause

a. Users and Petpro’s agree not to engage in any activity that may disparage, defame, or harm the reputation of each other. This includes not making negative comments, statements, or reviews about each other’s behavior, services, or interactions.
b. Users and Petpro’s further agree not to post, share, or publish any content that could be interpreted as negative, harmful, or misleading about each other.

c. This clause applies to all forms of communication, including but not limited to reviews, comments, social media posts, and public discussions.

d. The Company reserves the right to take appropriate action, including the removal of content, warnings, or account suspension, in the event of any breach of this mutual non-disparagement clause.

29. Forfeiture of Bookings and Rescheduling

a. Users and Petpro’s acknowledge that there may be circumstances beyond their control that could lead to the forfeiture of a booking.
b. Bookings may be forfeited due to reasons including but not limited to unavailability of pets due to weather conditions, illness, injury, grooming, pets not available due to holidays, or no access to the property.

c. In the event of such circumstances, Users and Petpro’s agree to communicate promptly and work together to either reschedule the booking or make alternative arrangements that are acceptable to both parties.

d. If a booking is rescheduled, it will require a new booking to be made through the same booking system. The Company shall not be held responsible for any losses or damages resulting from the forfeiture of a booking due to the reasons mentioned in this clause.

30. Booking Confirmation and Proof of Payment

a. All bookings made through the YOURHOUND Pet Services platform are considered confirmed upon receipt of proof of payment and the status of the order being marked as “Processing.”
b. Petpro’s are authorized to proceed with the booking only after receipt of proper payment confirmation and the order status changes to “Processing.”

c. In the event that a Petpro completes a booking or any further bookings without providing valid proof of payment, the Company reserves the right to take the following actions:

  • No payment will be processed for the completed booking(s).
  • The Petpro may be subject to a warning or suspension from the platform.
  • Repeated violations of this policy may result in the removal of the Petpro from the YOURHOUND Pet Services platform.
